Funtacee Parties – Terms & Conditions of Hire

1.⁠ ⁠About these terms

These terms apply to every booking made with Funtacee Parties. By paying a deposit, you ("the Hirer") agree to them in full.

1.⁠ ⁠"We", "us" and "Funtacee" mean Funtacee Parties, Chepstow, Monmouthshire. Phone/WhatsApp 07368 842943 · info@funtaceeparties.co.uk.


2.⁠ ⁠"Equipment" means everything listed on your booking confirmation, including disco tents, party tents, hot tubs, cinema equipment, lighting, sound equipment and accessories.


3.⁠ ⁠"Hire period" means the time from delivery to collection shown on your booking confirmation.


4.⁠ ⁠The Hirer must be 18 or over and must be present, or have a named adult present, at delivery and collection.


5.⁠ ⁠We serve South Wales and South England within 35 miles of Chepstow. Bookings further away may carry an extra delivery charge, quoted before you book.


6.⁠ ⁠Bookings and payment

A 50% non-refundable deposit secures every booking, and the balance is due 14 days before delivery.


1.⁠ ⁠Deposit. A deposit of 50% of the total hire price is required to secure any booking. A booking is only confirmed once we have received both the deposit and a completed booking form with the Hirer's full contact details and full delivery details (address, access and site information). No date is reserved until both are received. The deposit is non-refundable, except where Funtacee cancels (see section 4).


2.⁠ ⁠Balance. The remaining 50% is due no later than 14 days (2 weeks) before the delivery date.


3.⁠ ⁠Late bookings. Bookings made less than 14 days before the delivery date must be paid in full at the time of booking.


4.⁠ ⁠Unpaid balance. If the balance is not received by the due date, we will send a reminder. If it is still unpaid 48 hours later, we may treat the booking as cancelled by the Hirer and section 3 will apply.


5.⁠ ⁠Payment methods. Bank transfer, or another method we agree in writing. Please use your booking reference as the payment reference.


6.⁠ ⁠Prices. Prices are shown on our website (www.funtaceeparties.co.uk) and on your booking confirmation. The price on your booking

confirmation applies to your booking. Prices include delivery, set-up and collection within our standard area unless stated otherwise.


7.⁠ ⁠Changes to a booking. You can ask to change the date or add items at any time, subject to availability. One date change is free if requested 28 or more days before delivery; the deposit moves to the new date.


8.⁠ ⁠If you cancel

Cancellations must be made in writing (email or WhatsApp) and take effect on the day we receive them.

1.⁠ ⁠The deposit is non-refundable once paid, because we turn away other bookings for your date.


2.⁠ ⁠If you cancel 28 or more days before delivery, you may instead move your deposit to a new date within 6 months, once, subject to availability.

3.⁠ ⁠If we arrive and cannot set up because the site does not meet section 5 (for example no access, no power, or unsafe ground), this counts as a cancellation by you with less than 14 days' notice.


4.⁠ ⁠Bad weather on the day is not a reason for you to cancel without charge, unless we decide the equipment cannot be used safely (section 4).


5.⁠ ⁠Weather and cancellation by Funtacee

We will not put up tents or gazebos when gusts above 25 mph are forecast, and if we cancel you choose a free new date or a full refund.


1.⁠ ⁠Wind limit. We will not erect or leave standing any tent or gazebo when wind gusts above 25 mph are forecast or measured on site, or above any lower limit set by the manufacturer.


2.⁠ ⁠When we decide. We check the forecast for your postcode the day before and on the morning of delivery. We will contact you by 8am on the delivery day if we need to postpone.


3.⁠ ⁠If we cancel for weather or safety. You choose either a new date within 12 months at no extra cost, or a full refund of everything you have paid, including the deposit, within 7 days.


4.⁠ ⁠During the hire. If wind rises during the hire, you must close and secure the tent as shown at set-up and call us. We may take the tent down, or ask you to, for safety. No refund is due for part of a hire lost to weather once the equipment has been set up.


5.⁠ ⁠Rain. Our tents are designed for use in rain. Rain alone is not a reason to cancel.


6.⁠ ⁠Other reasons we may cancel. Breakdown or damage to equipment, vehicle failure, illness, or events outside our control. We will offer a suitable alternative where possible, otherwise a full refund. Our liability is limited to the money you have paid us.


7.⁠ ⁠Delivery, set-up and collection

We deliver, set up and collect; you provide a safe, level, accessible site with power and water where needed.


1.⁠ ⁠Times. We will agree a delivery and collection window with you. We will do our best to keep to it but cannot be held responsible for delays caused by traffic or events outside our control.


2.⁠ ⁠Access. There must be clear access for our team and equipment, at least 1 m wide, with no more than a few steps, as the equipment is heavy, unless agreed beforehand. Please tell us about narrow gates, steps or parking restrictions when booking.


3.⁠ ⁠Site. The area must be level, firm and clear of stones, debris and dog mess, with grass cut short. The Hirer must confirm there are no underground pipes or cables where pegs or stakes will go.


4.⁠ ⁠Space. The site must fit the equipment plus at least 1 m of clearance on every side, away from trees, overhead cables, fences and BBQs.


5.⁠ ⁠Power and water. Where required, the Hirer must provide a standard household socket within 6 m of the set-up point and, for hot tubs, a tap with a hose pipe long enough to reach the set-up point. Electrics must be protected by an RCD.


6.⁠ ⁠Permission. If the site is not your own property (a park, hall or venue), you must have the owner's permission to set up there.


7.⁠ ⁠Collection. The equipment must be ready for collection at the agreed time. If we have to wait or return, we may charge £25 per extra hour or trip.


8.⁠ ⁠Using disco and party tents


The Hirer is responsible for the tent and everyone using it for the whole hire period.

1.⁠ ⁠A responsible adult must supervise the tent at all times while it is in use, and children must be supervised by an adult.


2.⁠ ⁠Do not move the tent, remove pegs, weights or guy ropes, or change how it was set up.


3.⁠ ⁠No smoking, candles, sparklers, BBQs, fire pits, heaters or any naked flame in or near the tent.


4.⁠ ⁠No silly string, glitter, confetti cannons, face paint, chewing gum, sharp objects or pets inside the tent.


5.⁠ ⁠No food or drink other than water inside inflatable or fabric-floored tents, unless agreed in writing.


6.⁠ ⁠Keep lighting, sound and electrical items dry, and do not connect any other equipment to our extension leads.


7.⁠ ⁠Close the doors and windows and switch off all equipment if the wind picks up, and call us straight away.


8.⁠ ⁠Keep music to a reasonable level and respect noise rules for your area. The Hirer is responsible for any complaints from neighbours or the venue.


9.⁠ ⁠If any part of the equipment is damaged or stops working, stop using it and contact us.


10.⁠ ⁠You may be asked to bring the electrical equipment (lighting, speakers and similar) indoors after each use, especially when the tent is set up on grass, because of moisture inside the tent.


11.⁠ ⁠Hot tub and cinema hire


Hot tub and cinema hires run Thursday to Monday, and the Hirer is responsible for safe use and water care during that time.

Hot tub

1.⁠ ⁠We start filling the hot tub on delivery. A capable adult must stay on site until the water reaches the fill line shown at set-up, and then switch on the heating and flow as instructed. The hot tub can take up to 24 hours to heat. The thermal cover must be kept on at all times when the hot tub is not in use.


2.⁠ ⁠Adults must supervise children at all times. Children under 5 must not use the hot tub. No one may use it while under the influence of alcohol or drugs.


3.⁠ ⁠Users who are pregnant, or have heart, blood pressure or other medical conditions, should check with their doctor before use. Limit sessions to 20 minutes at a time.


4.⁠ ⁠Use the foot bath before getting in. No glass, food, oils, lotions, bubble bath, fake tan or hair dye in or around the tub.

5.⁠ ⁠Use only the chemicals we supply, as shown at set-up. Do not add any other products.


6.⁠ ⁠Do not exceed the maximum number of seated users stated for the tub.


7.⁠ ⁠Do not drain, move or switch off the tub, and do not unplug or extend the power lead.


Cinema

1.⁠ ⁠The projector, screen and speaker must be kept dry and switched off and covered when not in use or if rain is forecast.


2.⁠ ⁠You supply the device and content (laptop, streaming stick or similar). You are responsible for having the right licence for anything you show.


3.⁠ ⁠Do not move the projector trolley or screen once set up, except as shown at set-up.


4.⁠ ⁠Damage, loss and cleaning


The Hirer pays for loss or damage beyond normal wear and tear, and for extra cleaning.

1.⁠ ⁠The equipment is your responsibility from delivery until we collect it.


2.⁠ ⁠You must pay the cost of repair or replacement for any equipment lost, stolen or damaged during the hire, other than normal wear and tear.


3.⁠ ⁠We will check the equipment on collection and send you photos and a written quote for any damage within 7 days.


4.⁠ ⁠A cleaning charge of up to £50 applies if equipment is returned excessively dirty, wet with drinks or food, or with glitter, confetti or similar.

 Hot tubs that need a full re-clean because of misuse (for example oils, bubble bath or food) may be charged up to £75.

5.⁠ ⁠Please report any theft to the police and give us the crime reference number.



6.⁠ ⁠Liability and insurance

We hold public liability insurance; you are responsible for following these terms and supervising guests.

1.⁠ ⁠Funtacee Parties holds public liability insurance. A copy is available on request.


2.⁠ ⁠We are not responsible for injury, loss or damage caused by the Hirer or guests not following these terms or the safety instructions given at set-up.


3.⁠ ⁠We are not responsible for damage to lawns or ground caused by pegs, weights, hot tub water or normal use of the equipment, unless caused by our negligence.


4.⁠ ⁠We are not responsible for loss of or damage to personal belongings left in or near the equipment.


5.⁠ ⁠Nothing in these terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be limited by law.


6.⁠ ⁠Apart from that, our total liability to you is limited to the amount you paid for the hire.


7.⁠ ⁠Nothing in these terms affects your statutory rights as a consumer.


8.⁠ ⁠General


9.⁠ ⁠Complaints. Please tell us about any problem during the hire straight away so we can fix it. Written complaints should be sent to info@funtaceeparties.co.uk within 7 days of the hire ending.


10.⁠ ⁠Photos. We may photograph equipment at set-up and collection for our records. We will only use photos of your event on social media with your permission.


11.⁠ ⁠Your information. We use your details only to manage your booking and will not share them with anyone else except where required by law.


12.⁠ ⁠Changes to these terms. The terms in force on the date you pay your deposit apply to your booking.


13.⁠ ⁠Law. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
